  1. Deposit and Payment. In order to reserve your appointment time, clients will need to make a non-refundable deposit of $30.00 in order to book and hold your portrait session. Upon payment, I will reserve the time and date agreed upon exclusively for you. Deposits can be paid through the website or mailed directly to Kate Kelley Photography. Checks can be made payable to Kate Kelley Photography. The deposit will be subtracted from the cost of your selected portrait package. Balance is due the day of your session.
  2. Cancellation. If you need to change or cancel this appointment, please do so at least three or more calendar days before the session date and your deposit will be applied to a mutually agreed upon reschedule date. If you need to cancel and do so less than three days prior to or do not come to your scheduled appointment your deposit will not be refunded.
  3. Late Arrivals. Any Client that arrives late to their session will have the amount of time late deducted from the time allotted for the session.
  4. I do not allow anyone to take pictures with cell phones or any other cameras during our session. I reserve the right to end a session immediately if someone is taking pictures and your deposit will not be refunded.
  5. Weather. If your session needs to be rescheduled due to inclement weather I will make every attempt to reschedule the session within fourteen days.
  6. Artistic Rights. I retain the right of discretion in selecting the photographic materials released.
  7. Photographic Materials. All photographic materials shall be the exclusive property of the Photographer. The Photographer will choose the images from your session and release chosen images to the client via digital album. I will sign a release for you to print and share these images as you choose. All digital albums are delivered within ten days of your session with the exception of senior portraits. Senior Portraits will be delivered digitally within fourteen days of the session. If you need a rush order on any portrait package, you must specify that when booking your session. A rush order fee may apply. Please note for senior portraits; It is the responsibility of the senior/parent to know their high school’s deadline and submission guidelines if you choose to have me submit your chosen image directly to your school. If you would like me to submit your chosen portrait you must notify me fourteen days prior to your school’s submission deadline.
  8. Copyright and Reproductions. I will retain the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within my website and/or studio.
  9. All portrait packages include edited digital images. As advertised I will do minor natural edits that I deem necessary. I routinely will do minor edits such as skin touch ups, basic lighting changes and/or another minor edit/s. I have a natural photographic style and no major photoshop edits or/or add special effects will not be made to the photographs. Any questions please feel free to discuss this with me at the time of booking.
  10. Lifestyle Photography. If you choose to have me come to your home for a lifestyle portrait session it is agreed that I will be photographing, you and/or your family in the light provided in your home.
  11. Storage. I will store your images for ten days following delivery of your digital album. You are responsible for ensuring your photographs are properly stored after delivery. If you would like me to order a custom print and/or framing package for you, you must mention that to me within seven days of delivery. I am not responsible for storing photographs after ten days and I may delete images as I chooses after that time.
  12. Client’s Usage. You may use the prints, including digital files, in accordance with the permissions within this agreement. Your prints are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorize use of these images in this manner without my authorization. I will provide a digital file print release, the Client must act in accordance with the release. Any questions regarding this policy please speak with me at the time of your booking.
  13. Social Media. You may share blog post links and Facebook albums through use of the share functions and dissemination of direct links. Any images displayed on social media should be shared with my watermark to protect images from theft or unauthorized use.
  14. Failure to Perform. If I am unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond that are out of my control, I will make every attempt to reschedule the session within thirty days preferably sooner. If a reschedule date is unable to be agreed upon, I will return your deposit and shall have no further liability. Further, I am unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.
  15. Photographer’s Standard Price List. The charges in this agreement are based on my advertised portrait package price list. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
  16. Travel Fees. The Client shall pay agreed upon travel fee if the session is outside the photographer’s local area. This is to be discussed, agreed upon and specifically listed on this agreement.
  17. Indemnification. The Photographer shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.
